Welcome to Paigos (the “Platform” or “Service”). These Terms of Service (the “Terms”) govern your use of the Paigos website, mobile application, or any other linked services (collectively, the “Site”), specifically as a Traveler seeking to browse, book, or purchase travel-related experiences. By accessing or using any part of the Site as a Traveler, you agree to be bound by these Terms. If you do not agree, you may not use the Site as a Traveler.
1. OVERVIEW OF ROLES & SCOPE
Travelers: Individuals who browse, book, or purchase travel packages and experiences via the Paigos Platform.
Suppliers: Travel agencies or other entities creating and managing listings for travel packages.
Influencers: Individuals or brands promoting or collaborating on travel packages. (Often Suppliers and Influencers can be the same person/organization, but that role is subject to separate or additional terms.)
This document focuses on your rights, responsibilities, and limitations as a Traveler.
2. ACCEPTANCE OF TERMS
By visiting or using the Site and/or creating an account, you confirm that you have read, understood, and agreed to these Terms.
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or make bookings on the Site.
These Terms include important information about your legal rights, remedies, and obligations, including dispute resolution and limitation of liability.
3. ACCOUNT CREATION & USER AGREEMENTS
Account Requirement: Travelers must create an account to book experiences through Paigos (unless otherwise noted during certain promotional or “guest checkout” phases). You agree to provide accurate, current, and complete information during the registration process.
Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
Accuracy of Information: You represent and warrant that all details provided during registration or booking are true and accurate. Paigos may suspend or terminate your account if any information is found to be inaccurate or fraudulent.
No Guarantee of Lowest Price: Paigos does not guarantee the lowest price for any travel package. Pricing and availability are determined by the respective suppliers.
Travel Agency Terms: All bookings are subject to the availability and specific terms set by the supplier (e.g., airlines, hotels, tour operators). You acknowledge that each booking is subject to those third-party terms, and Paigos is not responsible for any terms imposed by suppliers.
4. BOOKINGS & PAYMENT
Booking Process: When you select a travel package, you agree to pay the total amount listed (including fees, taxes, etc.). Booking details (dates, number of travelers, inclusions) will be outlined during checkout.
Third-Party Payment Processor: Payments may be processed through a third-party payment service, and you agree to comply with their terms. Paigos itself does not store full payment card data.
Cancellations & Modifications by Suppliers:
Suppliers (travel agencies, hotels, airlines) may cancel or modify bookings due to unforeseen circumstances (such as flight schedule changes, hotel overbookings, force majeure, etc.).
Paigos is not liable for cancellations, schedule changes, or modifications made by suppliers. You may be entitled to refunds or alternative arrangements as dictated by the supplier’s individual policy.
Traveler Cancellations:
Each supplier defines its own cancellation policy, which may include partial or full refunds if certain deadlines are met.
You acknowledge that if you cancel outside of these deadlines, you may forfeit any right to a refund.
5. DISPUTE RESOLUTION & GOVERNING LAW
Arbitration Agreement
You and Paigos agree that any dispute or claim arising out of or relating in any way to your use of any Paigos Service as a Traveler (including the validity, interpretation, breach, or termination of these Terms) shall be resolved by binding arbitration rather than in court, except that either party may bring qualifying claims in small claims court. This agreement to arbitrate is governed by the Federal Arbitration Act (FAA).Governing Rules & Administration
The arbitration will be administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules (or Commercial Arbitration Rules, if applicable). These rules can be found at www.adr.org.Location & Procedures
Unless otherwise agreed by the parties, the seat (or legal place) of arbitration shall be in California. The arbitrator’s award shall be final and binding, and judgment on it may be entered in any court of competent jurisdiction.Waiver of Class or Consolidated Actions
You and Paigos both agree to arbitrate solely on an individual basis. Neither party may join or consolidate claims of others or arbitrate any claim as a representative or class action. The arbitrator shall not have the authority to conduct any class, collective, or representative proceeding.Waiver of Jury Trial
By agreeing to arbitration, both you and Paigos waive the right to a trial by jury or to participate in a class action for any dispute covered by this arbitration agreement.Governing Law
Except as set forth by the FAA for arbitration proceedings, California law (without regard to its conflict of laws principles) governs these Terms and any dispute that might arise between you and Paigos. If a dispute for any reason proceeds in court rather than in arbitration, such dispute shall be filed exclusively in the state or federal courts located in California, and you consent to jurisdiction and venue in those courts.
6. INTELLECTUAL PROPERTY & DATA USAGE
Third-Party Content: The Platform may display images, trademarks, and descriptions belonging to suppliers or influencers. All rights in third-party content remain the property of the respective owners.
AI Communications: Travelers acknowledge that Paigos may employ AI tools to facilitate communications, draft messages, or provide assistance based on publicly available data.
User-Generated Content: By submitting content (such as reviews, comments, or images) on the Platform, you grant Paigos a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, display, and distribute your content in connection with the operation and marketing of the Platform. You represent and warrant that such content is lawful and that you have all necessary rights to grant this license.
Paigos IP: All Platform materials (including text, graphics, logos, button icons, images, software, etc.) are owned or licensed by Paigos and are protected by intellectual property laws. You agree not to reproduce, distribute, create derivative works from, or otherwise exploit any part of the Platform without express written permission.
7. TERMINATION & ACCOUNT MANAGEMENT
Termination by Paigos: Paigos reserves the right to suspend or terminate your account at its discretion if it believes you are violating these Terms, engaging in fraudulent activities, or misusing the Platform.
Termination by Traveler: You may request account deletion and personal data removal by contacting Paigos customer support at admin@paigos.com. Paigos will promptly process such requests in accordance with applicable law.
Restriction of Access: Paigos may restrict, suspend, or terminate access to the Platform for any user suspected of fraud or policy violations without prior notice.
8. DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY
AS-IS Basis: The Platform and Services are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied.
No Warranty on Supplier Services: Paigos does not guarantee or endorse the quality, safety, or legality of supplier offerings, nor does it guarantee that travel packages will meet your expectations.
Limitation of Liability: To the fullest extent permitted by law, Paigos shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising out of or related to the use of the Platform, even if advised of the possibility of such damages. This includes, but is not limited to, lost profits, data loss, personal injury, or property damage.
9. CONSUMER PROTECTION & REGULATORY COMPLIANCE
Pricing Transparency: Paigos endeavors to provide accurate pricing information but is not responsible for price discrepancies due to supplier error or changes.
Refund and Cancellation Policies: Travelers should carefully review each Supplier’s (e.g., airline, hotel, tour operator) specific refund and cancellation policies before booking. Paigos does not guarantee or warrant the outcome of any refund request. Travelers must address refund inquiries, disputes, or claims to the Supplier first in accordance with that Supplier’s published policy. While Paigos may, at its discretion, offer support or mediation between Travelers and Suppliers, Paigos is not obligated to intervene in disputes or to provide any additional refund where a Supplier denies it.
Travel Documentation & Regulations: You are solely responsible for obtaining any necessary visas, passports, or other travel documentation. Paigos does not guarantee compliance with international travel regulations.
10. UPDATES & CHANGES TO THESE TERMS
Right to Modify: Paigos reserves the right to update or modify these Terms at any time.
Notification: In the event of significant changes, Paigos will notify Travelers via email or Platform notifications.
Acceptance of Changes: Your continued use of the Services after changes become effective constitutes your acceptance of the updated Terms.

12. ACKNOWLEDGMENT
By using Paigos as a Traveler, you acknowledge that you have read, understood, and agreed to these Terms of Service. If you do not agree to any part of these Terms, you must discontinue use of the Platform immediately.
